Abstract

This article examines the role of mediation and conciliation in resolving commercial disputes in the oil and gas industry in Nigeria. The oil and gas industry is a complex and high-stakes sector, where disputes can have significant financial and operational implications. Litigation-based approaches to dispute resolution can be time-consuming, costly, and damaging to relationships. In contrast, mediation and conciliation offer a more collaborative and flexible approach to dispute resolution. The article relies on both primary and secondary sources of information. The primary source comprised judicial decisions, legislations while the secondary source includes books, journal articles and the Internet. This article explores the benefits and challenges of using mediation and conciliation in the oil and gas industry. The article considers international best practices and model laws, such as the United Nations Commission on International Trade Law (UNCITRAL) Model Law on International Commercial Conciliation. Through a critical analysis of case law, legislation, and industry practice, this article demonstrates the potential of mediation and conciliation to resolve commercial disputes in the oil and gas industry effectively and efficiently. It argues that mediation and conciliation can help to reduce costs, improve relationships, and promote stability in the sector. The article concludes by highlighting the need for greater awareness and adoption of mediation and conciliation in the oil and gas industry.
